Personal Representatives have a legal responsibility and duty to distribute the deceased’s estate correctly. Underpinning this is ensuring you act on the deceased’s last wishes by holding the most up to date Will. To identify if a Will exists or to prove the Will you hold, our partners Certainty offer a National Will Search for both registered and unregistered Wills
Undertaking a search helps ensure you are acting on the deceased’s last wishes and demonstrates reasonable steps taken to search for a Will or later Will before proceeding with distribution. Will Searches are also recommended for Professional Deputies and Attorneys managing the property and financial affairs of their client, in order to determine whether a Will exists or proves the latest Will, while allow for end-of-life planning that is in the client’s best interests
The Certainty Will Search Combined includes a search of the Certainty the National Will Register, a database of accessing circa 8.4 million Will registrations, a notice placed on the Certainty Missing Wills Notice Board and a geographically targeted national search for Wills kept by solicitors and will writers based on areas where the person is known to have lived or worked.
The search runs for 28 working days (currently extended to 60 working days due to Covid) after which time a final report is provided detailing any results and signifying the end of the search. Responses are usually received between 3 to 10 working days. Estatesearch will receive all notifications of a potential Will either from Certainty or the solicitor, will writer, bank directly, and provide details as we are notified
